Afandi Terms of Service
Last updated:
1. Accepting these terms
By creating an Afandi account or using the service, you confirm that you have read these terms and agree to them on your own behalf or on behalf of the business you represent. If you do not agree, do not use the service.
2. Who we are and what the service is
Afandi is a service of BARMJINI Software Solutions (Zayouna, Baghdad). It includes an AI employee that answers the business's customers on the available channels (today: the business's website and Telegram; WhatsApp, Instagram and Messenger once they are enabled with Meta), a unified inbox, customer and sales management, reports, and campaigns once available — depending on the plan.
Afandi is a business-to-business (B2B) service: it is offered to companies and business owners to serve their own customers, and is not intended for personal or consumer use.
3. Your account
- You must be 18 or older and authorised to act for the business you register.
- You are responsible for the accuracy of your information, for protecting the email address and mobile number your sign-in codes are sent to, and for everything done from your account and your team's accounts.
- The account owner sets the team's permissions and is responsible for choosing who has access.
4. Free trial
A free 7-day trial, with no payment card needed. You create your account yourself; the 7 days start when you connect your first channel, and the trial includes the Business plan's features with 300 Afandi replies and 3 users. When it ends, you need to choose a plan and pay to continue. If you don't subscribe, Afandi stops replying, and you can ask us to delete your data as described in the privacy policy.
5. Plans and payment
- Prices are in Iraqi dinars (IQD) and are shown on the Afandi page and before you pay. Monthly subscription: Starter 120,000, Business 200,000 and Pro 450,000 IQD.
- Setup fee: 500,000 IQD — the same for every plan, paid only once, with your first subscription.
- Paying in advance: pay 6 months in advance for 10% off the subscription, or 12 months for 20% off. The discount does not apply to the setup fee.
- Payment is by Zain Cash, FIB or cash.
- Your subscription renews when you pay for the next period. If payment is not made on time, we may suspend the service until it is.
- Reply limit: each plan includes a number of replies per month, and every message Afandi sends to your customers counts as one reply (Starter includes 1,000 replies, Business 5,000 and Pro 20,000), along with a user limit that depends on the plan.
- We let you know when you reach 80% of the month's replies. Once they run out, Afandi stops replying automatically and new conversations go to your team to answer themselves, until the next month starts, you buy extra replies, or you upgrade your plan. The size and price of an extra-reply pack are agreed with you before you pay.
- Meta's charges are separate: Meta charges for some types of WhatsApp messages according to its own pricing. These charges are not included in Afandi's prices; you pay them directly to Meta with the payment method you add in your WhatsApp Manager account, and BARMJINI neither receives nor controls them.
- The setup fee is non-refundable once setup has started. Subscription fees are non-refundable for a period that has already begun, unless the law requires otherwise.
6. Using WhatsApp, Meta's platforms and AI
- Afandi works through Meta's official business platforms (the WhatsApp Business Platform, Messenger and Instagram), and you must comply with Meta's terms and policies, including the WhatsApp Business Terms and the WhatsApp Business Messaging Policy, the Commerce Policy, and the Messenger and Instagram platform policies.
- No spam and no marketing without consent: send marketing messages or campaigns only to customers who have agreed in advance to receive messages from you, and immediately stop messaging anyone who asks you to stop.
- Follow Meta's messaging-window rules: free-form replies must be sent within 24 hours of the customer's last message; after that, send only the messages Meta allows (such as approved WhatsApp templates).
- Afandi is meant only for serving your business's customers and sales — it is not a general-purpose assistant.
- Meta may restrict or suspend a number, Page or account that breaches its policies; that decision is Meta's, not ours. We help you comply, but we cannot guarantee Meta's decisions.
7. Your responsibility for content
- You are responsible for the information you teach Afandi (prices, offers, conditions) and for keeping it accurate and up to date.
- You are responsible for the messages your team sends, and for campaigns.
- You may not use Afandi to sell products or services that are illegal or prohibited by Meta's policies, to send spam, to commit fraud, or to collect sensitive data without a legitimate reason.
8. Limits of AI
Afandi tries to answer from the information it has, but it can make mistakes. Afandi is not a substitute for professional advice on medical, legal or financial matters, and you must keep the hand-over-to-staff rules turned on for such cases. You remain responsible for reviewing its replies and any decisions based on them.
9. Data and privacy
Your data and your customers' data belong to you. You are the data controller of your customers' data, and BARMJINI processes it on your behalf as a data processor. You allow us to process it only as far as needed to provide the service, as described in the privacy policy. You are responsible for telling your customers that you use a digital service (including AI) to reply to their messages.
10. Intellectual property
The Afandi platform, its design, its code and its visual identity (the logo and the styled name) belong to BARMJINI. You get the right to use the service for as long as your subscription lasts, without the right to copy, sell or reverse-engineer it.
11. Service availability
We aim to keep the service running at all times, but there may be interruptions for maintenance or because of third parties such as Meta or internet providers. We try to give you advance notice of planned maintenance.
12. Suspension and cancellation
- You can cancel your subscription at any time; it stays active until the end of the paid period.
- We may suspend or close an account that breaches these terms or Meta's policies (WhatsApp, Messenger and Instagram), and we will tell you why unless the law prevents us.
- We may suspend a channel or an account immediately — without prior notice if necessary — if we detect spam, a breach of Meta's policies, or use that could harm customers or the service, or if Meta requires it.
- After cancellation or termination, Afandi stops replying, and you can ask us to delete the data as described in the privacy policy (Data deletion instructions).
13. Limitation of liability
To the extent permitted by law, BARMJINI is not liable for indirect losses, such as lost profits or lost customers, caused by using the service, by service interruptions, or by Meta's decisions. Our total liability will not exceed the amount you paid for the last 3 months.
14. Changes to these terms
We may update these terms. If a change is significant, we will notify you in the app before it takes effect, and continuing to use the service afterwards means you accept it.
15. Governing law
These terms are governed by the laws in force in the Republic of Iraq. We will first try to settle any dispute amicably; if that fails, the courts of Baghdad have jurisdiction.
